1. The act of July 23, 1866, 14 Stat. 209, provided for a reduction in the number of seats on the Court from ten to seven by discontinuing the appointment of associate justices to vacancies until the prescribed size of the Court was met. In accordance with the statute, no successors to John Catron and James Wayne were appointed. Before the Court could be further reduced, the act of April 10, 1869, 16 Stat. 44, increased the number of authorized seats to nine.
