The Judiciary Act of 1789 established the U.S. Circuit Court for the District of Delaware and assigned the district to the Middle Circuit.
February 13, 1801

The Judiciary Act of 1801 established six regional circuit courts to replace the circuit courts organized by judicial districts. The Act placed the District of Delaware under the jurisdiction of the U.S. Circuit Court for the Third Circuit.

Congress repealed the Judiciary Act of 1801 and restored the organization of the judiciary in effect before 1801, thereby re-establishing the U.S. Circuit Court for the District of Delaware.

Judiciary Act of 1802 assigned the District of Delaware to the Fourth Circuit.

Congress reorganized the circuits and assigned the District of Delaware to the Third Circuit.
