After Matthew McAllister resigned from the California circuit judgeship, Congress abolished the California Circuit and incorporated California, along with Oregon, into a new Tenth Circuit. Simultaneously, a tenth seat was added to the Supreme Court. Supreme Court justice Stephen Field was allotted to the Tenth Circuit until it was abolished in 1866.
