Patent Act

February 21, 1793

In the Patent Act of 1793, Congress granted patent holders the right to bring infringement suits in the U.S. circuit courts. The statute was an early example of Congress granting the courts federal question jurisdiction in a specific area prior to the establishment of general federal question jurisdiction in 1875. Congress expanded upon the act in 1819 when it granted the circuit courts jurisdiction over all cases “arising under” the federal patent laws.
