Nominated by William McKinley on February 21, 1899, to a seat vacated by Louis Emory McComas. Confirmed by the Senate on March 2, 1899, and received commission on March 2, 1899. Service terminated on May 1, 1903, due to appointment to another judicial position.

Received a recess appointment from Theodore Roosevelt on April 1, 1903, to a seat vacated by Edward F. Bingham; nominated to the same position by Theodore Roosevelt on November 10, 1903. Confirmed by the Senate on November 16, 1903, and received commission on November 16, 1903. Service terminated on March 6, 1914, due to death.
