Received a recess appointment from Martin Van Buren on October 30, 1839, to a seat vacated by Thomas Lee; nominated to the same position by Martin Van Buren on January 29, 1840. Confirmed by the Senate on February 17, 1840, and received commission on February 17, 1840. Service terminated on May 1, 1856, due to death.
