ADR and settlement generally.
The Western District of Virginia has no formal ADR policy or programs. One judge in the district has on occasion used a court-sponsored minitrial. The scheduling orders prepared in each civil case are the court's primary case management tool.
Arbitration.
The Western District of Virginia is one of ten courts authorized by 28 U.S.C. §§ 651-658 to establish a voluntary, nonbinding court-annexed arbitration program. The court has chosen not to implement a program.
Judicial settlement conferences.
Judicially hosted settlement conferences are used as needed.
