Order No. 13A (Modifying Amount of Common Benefit Fund Assessment): Dated December 28, 1999, reduces common benfit fund asssessment rate on "opt-out" settlements to 4% of gross monetary recovery effective 1/1/2000, and provides for refund to implant recipients and/or their attorneys amounts assessed in excess of the 4% rate. Order No. 52: Dated March 12, 1999, directing plaintiffs' attorneys in some 4,000+ listed cases to send to SCP (not to the Clerk of the court) by May 14, 1999, brief reports regarding the status (including listing of "active defendants") of those cases. Order (unnumbered): Dated October 7, 1998, denying as untimely two motions for "relief" from Order No. 13 (imposing the 6% assessment to be paid to the common benefit fund), but then proceeding to discuss certain contentions made in the motion based on state laws regulating contingent fee contracts. Order (proposed Inamed/McGhan/CUI class settlement): Dated June 2, 1998, provisionally certifying mandatory Inamed/McGhan/CUI settlement class, tentatively approving proposed class settlement, and temporarily staying all litigation against Inamed/McGhan/CUI and their affiliates. Assuming certain conditions are met, detailed notices regarding the settlement would be mailed to class members (probably in September 1998), followed by a hearing (probably in December 1998) to determine whether the settlement should be approved. Order No. 27M: Dated May 19, 1998, declaring McGhan Medical Corp. (a California corp.) and INAMED Corp. in default under RSP and appropriately modifying injunction against claims against such companies and their affiliated released parties respecting post 8/84 McGhan implants. Order No. 44: Dated April 6, 1998, directing plaintiffs to respond by July 17, 1998 (to Judge Pointer, not to Clerk's Office) indicating which of 15,000+ possibly dormant cases should not be dismissed, but rather should be scheduled for remand to Transferor Courts. Revised Settlement Program for Foreign Claimants: Entered December 13, 1996, approving settlement program from Bristol, Baxter, and 3M, offering benefits in settlement of claims of eligible foreign "Current Claimants" that essentially mirrors (except for rupture supplements and Long-Term benefit options) benefits offered to domestic claimants and that, for other eligible foreign registratrants, provides for payments by settling defedants into a fund with an allocation as yet undefined but with funding obligations equivalent to the average amount provided to participatnts under Ontario/Quebec class action settlement. Program envisions further implementation of details, including notice to eligible foreign registrants and with options after notice to "opt out". Foreign Registrants are requested not to seek additional information at this time; they will be provided details later.
