This page provides information about the Joint Plan for Reorganization for Dow Corning Corporation, which is pending in the Bankruptcy Court for the Eastern District of Michigan.  This information is posted on this webpage by ALN and Judge Pointer as a service and is based on materials provided to Judge Pointer by the parties. By providing this information, Judge Pointer is not taking any position on how claimants should vote on the Joint Plan.

On March 15, 1999, the Amended Disclosure Statement for the Joint Plan of Reorganization for Dow Corning Corporation was mailed to claimants and attorneys.   Included in the Disclosure Statement package is an official ballot for claimants to use to vote in support or or in opposition to the Joint Plan.  To be counted, the ballots must be  received by the Ballot Tabulation Agent  by 5:00 p.m., Eastern time, on May 14, 1999 (and not merely postmarked by that date).  The Balloting Agent is Corporate Election Services; P.O. Box 2400; Pittsburgh, PA  15230 (or, for overnight deliveries, 650 Smithfield Street; 5th Floor; Pittsburgh, PA  15222).

Interested persons can download copies of the Disclosure Statement and Plan documents from either of the following two websites:

The Tort Claimants Committee and Dow Corning have also jointly established an Information Center, toll-free within the U.S. and Canada at 1-888-577-7526.   (Collect calls from outside the U.S. and Canada can be made to 718-361-4500.)   During the balloting period, the Information Center will have representatives available from 8 a.m. to 12 midnight, Eastern time, Monday through Saturday, with some representatives being reasonably fluent in a number of languages in addition to English.    Creditors who do not receive the official Disclosure Statement Package by March 25, 1999, can call one of these numbers in order to get the official ballot to be used in voting.

DO NOT MAIL BALLOTS TO--OR SEEK INFORMATION ABOUT THE PLAN OR VOTING PROCEDURES FROM--THE U.S. BANKRUPTCY COURT FOR THE EASTERN DISTRICT OF MICHIGAN, THE U. S. DISTRICT COURT FOR THE EASTERN DISTRICT OF MICHIGAN, OR THE U.S. DISTRICT COURT FOR THE NORTHERN DISTRICT OF ALABAMA.

The confirmation hearing on the Joint Plan is scheduled to begin before Bankruptcy Judge Arthur J. Spector on June 28, 1999, at the Bankruptcy Court in Bay City, Michigan.
